Team Entry T&Cs

These terms and conditions are issued to each team, and your agreement is required for acceptance of your team in the Midnight Madness event. This event is hosted by the Organisers (as defined below). 

In these Terms & Conditions for TEAM ENTRY the following definitions shall apply:

– “Organisers” “we”, “us”, “our”: MindBlown Ltd (Company number 15124088);
– “Charity”: Raise Your Hands (Registered Charity number 1174956);
– “DPA”: The Data Protection Act 2018;
– “Event”: Midnight Madness organised by the Organisers;
– “Terms & Conditions for TEAM ENTRY” – these terms and conditions, accepted by every team captain on registration.
– “Player: Terms & Conditions” – terms and conditions, accepted by each player at player registration;
– “Event Rules”: issued by the Organisers (in the lead up to the event, and as amended and communicated during the event);
– “Event Date”: the date the Event starts;
– “Officials”: any event officials as appointed by the Organisers from time to time;
– “Personal Data”: Shall have the meaning given to it in the DPA;
– “Privacy Policy”: As described in section 5;
– “you” “your”: the participant in the Event.

1. Entry

Each team fee paid registers one team slot for the Event. 

By registering a team for the Event, you are agreeing to enter the Event and also agree to abide by the Terms & Conditions for TEAM ENTRY and any instructions given to you by the Organisers and officials of the Event. 

You are responsible for recruiting the six players for your team. The Organisers recommend having one or two reserve players ready in case needed to make up a full team on the night. Teams of more than six players will not be permitted. Due to the nature of the puzzles, teams with five or fewer players will have their experience significantly impacted – but will be permitted to play.

All team players will have to register separately and agree to separate Player Terms & Conditions that pertain to their participation.

The entry fee is non-refundable unless the Event venue, time and/or date is changed in a material way, or if the Event is cancelled altogether (subject to paragraph 3 below). 

The Charity asks that you let them know as soon as possible if you need or want to withdraw your team from the Event for any reason.

2. Fundraising

The Event is in aid of the Charity and any fundraising that takes place is arranged directly with the Charity. This may include communication with you that encourages participation and raising funds.

The Charity will handle all payments from the teams; both team fees and donations. 

To help support the work of the Charity, each team is asked to raise at least £22,000.

Companies can choose to cover their donation from a single or multiple sources (including, but not limited to, corporate foundations, individual backers, the business itself and sponsorship from people connected to the players). 

The Hall of Heroes fundraising page tracks all participating team donations in a dashboard format. Taking part in the Hall of Heroes is optional. 

By agreeing to take part in the Hall of Heroes fundraising page, your company name and totals raised will be published online. Donors to your page will be asked separately if they consent to their names being published.

3. Cancellation by us

The Organisers may cancel the Event if circumstances beyond our reasonable control arise, including, without limitation, war, civil or political unrest, terrorism or inclement weather conditions or pandemics.

In such circumstances the Organisers and Charity will use reasonable endeavours to provide suitable methods of notice including email, mobile phone, and text message.

If the circumstances leading to cancellation are covered by the Organiser’s cancellation insurance, your Team Fee will be refunded.

If the circumstance leading to cancellation is not covered by the Organiser’s cancellation insurance, your fee will not be refunded. However, if it is possible to reschedule the event to a later date or transfer your entry to the following year this will be done at no extra cost.

In the event of cancellation of the Event neither the Organisers or Charity will have responsibility for any costs incurred as a result of cancellation, including travel or accommodation costs. In addition, no refunds will be issued, and registration fees will be considered a donation to Raise Your Hands unless otherwise stated.

4. Privacy and Data protection

The Charity will gather Personal Data in order to promote and administer entry to the Event.

Please read The Charity’s Privacy Policy carefully to understand the Charity’s practices regarding Personal Data and how it will treat it. You agree that the Charity may share relevant Personal Data with the Organiser for purposes of the Event administration.

5. Intellectual Property and Event Imagery

All intellectual property relating to the Event, including but not limited to puzzles, designs, and branding, remains the property of the Charity and may not be reproduced or used without permission.

The Event will be filmed and/or otherwise recorded and photographs will be taken that may capture your participation in the Event. 

You agree to the publication of such photographs, filming, recording and broadcasts and their use by the Charity and those authorised by us in any way which the Charity may see fit now or in the future including but not limited to film, broadcast, radio, TV, publications and publicity.

You agree that any audio, visual, or audio-visual recordings that you make of the event or any part of it are for personal use only, will not be shared on social media and cannot be used for commercial purposes.

6. Liability

All participants attend and enter the Event entirely at their own risk. 

In no event shall the Organisers or Charity be liable to you whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Terms & Conditions for TEAM ENTRY for any: 

– Injury or death;
– loss or damage to persons or their property;
– loss of profit, business, revenue or anticipated savings;
– loss of reputation or goodwill;
– consequential or indirect loss, regardless of whether the loss or damage:
  1. would arise in the ordinary course of events;
  2. is reasonably foreseeable; or is in the contemplation of the parties, or otherwise.

For the avoidance of doubt, nothing in this clause shall limit the Organiser’s or Charity’s liability for any other liability that cannot be restricted or excluded by law.

7. General

These Terms & Conditions for TEAM ENTRY shall be governed by English law, and the parties submit to the exclusive jurisdiction of the English courts.

If any provision of these Terms & Conditions for TEAM ENTRY are invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.

These Terms & Conditions for TEAM ENTRY do not create, confer or purport to confer any benefit or right enforceable by any person not party to it.

The Charity conducts all fundraising and solicitation for the event and carries sole responsibility for meeting the requirements of the Charities Act, 2011.

8. Complaints Process

The Organisers and Charity are committed to delivering a well-organised and enjoyable event. If you have any concerns or complaints, please raise them as follows:

– During the Event: Please speak directly to an Event Official who will attempt to resolve the issue on the spot.

– After the Event: You may submit a written complaint within 14 days of the Event Date by email to madness@raiseyourhands.org.uk. Please include your full name, team name (if applicable), and details of your concern.

All complaints will be acknowledged within 5 working days and responded fully within 14 working days. All complaints will be treated seriously and handled in accordance with the Charity’s values of fairness, respect, and accountability.

9. Amendments to these Terms

The Organisers reserve the right to make reasonable amendments to these Terms & Conditions for TEAM ENTRY at any time prior to the Event Date. Any significant changes will be communicated to registered participants via the contact information provided during registration.

Continued participation in the Event following any changes constitutes your acceptance of the amended terms.
