Player T&Cs

These terms and conditions are issued to each player, and your agreement is required for acceptance of your participation in the Midnight Madness event. This event is hosted by the Organisers (as defined below). 

In these Player Terms & Conditions the following definitions shall apply:

– “Organisers” “we”, “us”, “our”: MindBlown Ltd (Company number 15124088);
– “Charity”: Raise Your Hands (Registered Charity number 1174956);
– “DPA”: The Data Protection Act 2018;
– “Event”: Midnight Madness organised by the Organisers;
– “Terms & Conditions for TEAM ENTRY” – team terms and conditions, accepted by every team captain on registration.
– “Player: Terms & Conditions” – these terms and conditions, accepted by each player at player registration;
– “Event Rules”: issued by the Organisers (in the lead up to the event, and as amended and communicated during the event);
– “Event Date”: the date the Event starts;
– “Officials”: any event officials as appointed by the Organisers from time to time;
– “Personal Data”: Shall have the meaning given to it in the DPA;
– “Privacy Policy”: As described in section 5;
– “you” “your”: the participant in the Event.

1. Entry

The minimum age for entry is 18 years of age on the day of the Event.

The Charity asks that you let the Charity know as soon as possible if you need or want to withdraw from the Event for any reason. 

Due to the nature of the puzzles, teams with less than six players will have their experience significantly impacted so your attendance is crucial to your teammates. 

Entry places in the Event are tailored to participants and you may not transfer your place to anyone else who has not registered, as it may cause problems of identification in the event  for example, if medical assistance is required during the Event. 

By registering for an Event you agree to comply with these Player Terms & Conditions – and the Event Rules issued by the Organisers before and at the Event.

The Charity is committed to making Midnight Madness as inclusive as possible. If you require any adjustments or have specific accessibility needs, please contact the Charityin advance. Unfortunately, the Event courses are unsuitable for wheelchair or mobility scooters so wheelchair users and mobility scooter users are highly unlikely to be able to take part in the Event. The health and safety of participants is very important to the Charity and we cannot guarantee that each type of wheelchair and mobility scooter will be able to manoeuvre the route.

2. Event safety

The Event involves staying up all night and significant amounts (multiple miles) of walking (or, if you prefer, running) around London. 

Participants are responsible for ensuring that they are sufficiently fit and healthy to take part in the Event. Any participant unsure of their physical ability to take part in an Event must seek medical advice prior to the Event. For further information contact health@mindblown.io 

Participants are responsible for ensuring that they are wearing appropriate attire (including footwear) when taking part in the Event, taking into account the nature of the Event, the weather forecast and the terrain involved.     

At all times during the Event you must adhere to all instructions given by the Event officials.

You understand that participating in the Event may expose you to a variety of risks from activities that are part of the Event, including variothe Charityphysical activities, crossing streets, and substantial walking in unsupervised areas. 

You understand that risks may include, but are not limited to: 

– injury or death; 
– potential allergic reactions; 
– high-powered electronics and magnets which, for example, may affect pacemakers;
– exposure to bright lights and strobe lighting;
– working at height / being at height; 
– damage or destruction of your personal property or the personal property of others (e.g. if you drop your phone or damage an e-bike from sharing scheme); 
– crime affecting your person or property (as you will be on public streets); 
– prosecution by statutory authorities (e.g. if you choose to do anything which breaks a law).

By taking part in the Event, all participants acknowledge that there may be conditions or circumstances beyond the Organiser’s control that can lead to unforeseen risks. If you have any concerns or queries, please contact the Charity on madness@raiseyourhands.org.uk before agreeing to take part in the Event. 

You agree and warrant that if, at any time during the Event, you feel anything whatsoever to be unsafe, you will promptly advise the Event Officials and will leave the relevant area and/or discontinue such activity.

Participants are responsible for arranging their own insurance cover for personal accidents, medical expenses, and personal belongings.

3. Conduct

All participants must comply with UK laws and abide by any rules, instructions or regulations displayed or given on the day of the Event by the Charity, Police and/or Organisers, including those relating to the health and safety of participants. 

The Charity respectfully asks that all participants do not use aggressive or abusive language towards the Event organisers, officials, actors, volunteers and other participants. You should also avoid behaving in a way which may cause injury or harm to other participants or actors, or which may cause offence or damage the reputation of the Charity or the Organisers.

The Charity respectfully ask all participants to be respectful of local residents whilst out on the route and not to make any excessive noise. 

The Charity and Organisers reserve the right to refuse participation in the Event or to ask you to cease participation if: 

– you fail to follow instructions given by Event officials; 
– you attempt to participate in the Event in a manner that we, acting reasonably, believe: 
  – may cause injury to you or another participant;
  – may damage or harm the environment;
  – in our opinion is likely to cause offence; 
  – otherwise causes a risk or potential risk to health and safety including any failure, in whole or in part, to comply with the restrictions in Condition 2;
– In our opinion you are unfit to participate in the Event due to:
  –
the consumption or use of alcohol or drugs;
  – an injury or illness; 
– you fail to arrive at the start location at the specified time; 
– you break the Event rules, share information between teams or tamper with the puzzles.

4. Cancellation by us

The Organisers may cancel the Event if circumstances beyond our reasonable control arise, including, without limitation, war, civil or political unrest, terrorism or inclement weather conditions or pandemics.

In such circumstances the Organisers and Charity will use reasonable endeavours to provide suitable methods of notice including email, mobile phone, or text message. It is the player’s responsibility to ensure that the Charity has up to date methods of communication for you.

In the event of cancellation of the Event neither the Organisers or Charity will have responsibility for any costs incurred as a result of cancellation, including travel or accommodation costs. 

5. Privacy and Data protection

The Charity will gather Personal Data in order to promote and administer entry to the Event.

Please read The Charity’s Privacy Policy carefully to understand the Charity’s practices regarding your Personal Data and how it will treat it. You agree that the Charity may share relevant Personal Data with the Organiser for purposes of the Event administration.

The Charity is the Data Controller.  The Organiser is a Data Processor.

The Charity will only share data with the Organiser when relevant to the smooth running of the event and the Organiser will not hold any Personal Data beyond the time needed to administer the event (unless you provide a specific marketing opt-in).

In the case of an emergency, the Charity may also pass personal details provided by you to the emergency services or health care professionals, and also use them for the purposes of contacting your emergency contact. Participants must provide an emergency contact during registration.

6. Intellectual Property and Event Imagery

All intellectual property relating to the Event, including but not limited to puzzles, designs, and branding, remains the property of the Charity and may not be reproduced or used without permission.

The Event will be filmed and/or otherwise recorded and photographs will be taken which may capture your participation in the Event. 

You agree to the publication of such photographs, filming, recording and broadcasts and their use by the Charity and those authorised by the Charity in any way which the Charity may see fit now or in the future including but not limited to film, broadcast, radio, TV, publications and publicity.

You agree that any audio, visual, or audio-visual recordings that you make of the event or any part of it are for personal use only, will not be shared on social media and cannot be used for commercial purpose.

If you would like to discuss the possibility of being excluded from photos/film, please contact Raise Your Hands on madness@raiseyourhands.org.uk before the Event Date.

7. Liability

All participants attend and enter the Event entirely at their own risk. 

In no event shall the Organisers or Charity be liable to you whether for breach of contract, any tortiothe Charityact or omission (including negligence) or otherwise, under or in connection with the Player Terms & Conditions for any: 

– injury or death;
– loss or damage to persons or their property;
– loss of profit, business, revenue or anticipated savings;
– loss of reputation or goodwill;
– consequential or indirect loss, regardless of whether the loss or damage:
  1. would arise in the ordinary course of events;
  2. is reasonably foreseeable; or is in the contemplation of the parties, or otherwise.

Notwithstanding any provision in these Player: Terms and Conditions, the Organisers and Charity do not seek to exclude or limit our liability for any other matter for which it is not possible to exclude or limit liability by Applicable Laws (including Your statutory rights and rights as a consumer).

8. General

These Player Terms & Conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the English courts.

If any provision of these Player Terms & Conditions are invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.

These Player Terms & Conditions do not create, confer or purport to confer any benefit or right enforceable by any person not party to it.

9. Complaints Process

The Organisers and Charity are committed to delivering a well-organised and enjoyable event. If you have any concerns or complaints, please raise them as follows:

– During the Event: Please speak directly to Game Control who will attempt to resolve the issue on the spot

– After the Event: You may submit a written complaint within 14 days of the Event Date by email to madness@raiseyourhands.org.uk. Please include your full name, team name (if applicable), and details of your concern.

All complaints will be acknowledged within 5 working days and responded fully within 14 working days. All complaints will be treated seriously and handled in accordance with the Charity’s values of fairness, respect, and accountability.

10. Amendments to these Terms

The Charity reserves the right to make reasonable amendments to these Player Terms & Conditions at any time prior to the Event Date. Any significant changes will be communicated to registered participants via the contact information provided during registration.

Continued participation in the Event following any changes constitutes your acceptance of the amended terms.
